RULES OF OPERATION AND INTERNAL RULES

OPERATING RULES

The operating regulations regulate the details of the exercise of the rights and obligations of the legal representatives of children in the children's group and details of the rules of mutual relations with the nursery school staff.

1. The operation of the children's group (hereinafter referred to as "DS") is on weekdays from 7:30 am to 4:30 pm, and in the evenings or on weekends by prior arrangement with parents.

2. Children come to the DS no later than 9:00 am, otherwise only after prior agreement of the legal representative with the DS staff.

3. The child's legal representative can entrust another person with handing over and picking up the child in the DS on the basis of filling out the "Authorization to pick up from children's group" form.          

4. The child's absence is excused no later than 8:15 am on the given day. The child's absence from DS for more than ten working days without an excuse is considered a violation of the operating rules.

5. The child's legal representative/proxy hands over the child to the DS without obvious signs of illness. In case of doubt about the health status of the child, the DS staff will not take over the child's legal representative/agent.

6. When symptoms of illness occur in a child, the care staff is obliged to inform the child's legal representative free of charge and hand the child over to him.

7. If an infectious disease occurs in a child or in the family, the legal representative shall immediately report this fact to the DS staff.

8. The legal representative will hand over to the DS staff a medical certificate at the end of the child's illness and the doctor's consent to the child's return to the team for all infectious diseases lasting more than 7 calendar days.

9. At the time designated for the children's arrival at the DS, the legal representative/proxy handovers the child personally to the DS staff after changing his/her clothes in the children's changing room.

10. The legal representative/authorized person collects the child from the staff in the DS changing room.

11. If the legal representative/proxy does not pick up the child by the end of the operating hours of the DS, the DS staff:

a) contact the child's legal representative and the DS executive by phone
b) take further steps, in particular they will follow the procedure recommended by the Ministry of Education, Youth and Sports - they will contact the municipal authority, which according to § 15 of Act No. 359/1999 Coll., on the social and legal protection of children, as amended, is obliged to ensure the child's immediate care, or contact the Police of the Czech Republic.

12. The DS staff is responsible for the child from the time they take the child over from the legal representative/proxy until the time they hand it over to the legal representative/proxy or proceed according to point 11.

13. While staying at the DS, the legal representative/authorized person observes these operating rules and when interacting with the staff of the DS and with other persons present, the rules of decency and mutual consideration.

14. Due to the needs of the children, we do not recommend the legal representative/proxy to visit the child during his stay in the DS. The possible stay of the legal representative/proxy with the child in the DS must be approved by the DS employee present.

15. The DS program is governed by the Education and Care Plan.

16. To ensure the safety of children during their stay inside the DS and outside the DS premises, the DS staff is trained in the field of safety and health protection and fire protection. Smoking, handling open flames and consumption of alcohol are strictly prohibited in all DS premises.

17. The legal representative/proxy is prohibited from giving children toys and objects that could be dangerous to children, and valuable toys and objects are not allowed to be given to children.

18. In the event of a declaration of emergency (fire, natural disaster, etc.), DS personnel follow valid fire protection documents or the instructions of the responsible persons.

19. During DS operation, the doors of the main entrance and all escape exits can be freely opened from the inside.

20. The children's own garden, public playground and other suitable outdoor spaces are used for the children's stay outside, while the children's stay outside depends on the weather. The reason for not staying outside can be strong wind, rain, fog, polluted air or unreasonably low or high temperature.

21. Lunch, morning and afternoon snacks are provided by the DS provider or the child's legal representative, based on an agreement between the provider and the legal representative of the child placed in the DS. The drinking regime is provided by caregivers within the operation of DS. The legal representative/proxy hands over the lunch and possibly the child's morning and afternoon snack in the case of an individual meal for the given day to the DS staff in the DS dressing room upon arrival with the child, and the food handed over in this way is marked with the child's name and surname. At the same time as handing over the food, he instructs the DS staff on how to give the food to the child.

22. The provider's liability insurance covers possible injuries and accidents that occurred during the child's stay at DS and during events organized by DS. DS has general liability insurance for entrepreneurs and legal entities. The insurance contract is available for viewing upon request. General liability insurance covers only cases where there is negligence on the part of the caregiver. For this reason, we recommend that legal representatives take out their own accident insurance for the child.  

23. Information about upcoming events, including restrictions on DS operations, is always announced in accordance with DS Internal Rules.

24. Children's group Abacus, Abacus II, Abacus III and Abacus Písek is a children's group for the public with a capacity of up to 24 children, providing childcare services at Zachariašova 2113/3, České Budějovice 370 04 and V Koutě 91, Písek 397 01. The operator provides a childcare service with partial payment of costs by the parents.

25. The date of approval of the Operating Rules is September 1, 2018, valid for an indefinite period.

 INTERNAL RULES

PART I. BASIC PROVISIONS

Article 1 INTRODUCTORY PROVISIONS

1.1 The rules of the organization of the provision of childcare services in the children's group Abacus (hereinafter referred to as the "rules") are issued on the basis of § 10 of Act No. 247/2014 Coll., on the provision of childcare services in the children's group and on the amendment of related laws, as amended later regulations (hereinafter referred to as "the Act").
 
1.2. The provider is Abacus International Education, zs. with registered office at Zachariašova 2113/3, České Budějovice 370 04 (hereinafter referred to as the "provider").

1.3. The children's group Abacus, Abacus II and Abacus III is located at Zachariašova 2113/3, České Budějovice 370 04, and the children's group Abacus English Preschool - Children's group Abacus Písek is located at V Koutě 91, Písek 397 01.

1.4. Children's group (hereinafter referred to as "DS") is conceived as a childcare service operated on the basis of authorization to provide childcare services in a children's group according to the Act. DS is intended for children from the age of two until the start of school attendance. The child care service in DS is provided by parents or another person who, by the decision of the competent authority, has entrusted the child to care replacing parental care, for regular use in order to reconcile family and personal life with the performance of service/ work. The placement of a child can be requested by a parent or another person (collectively referred to as "legal representative") who meets the criteria for a child's admission to the Abacus children's group.

1.5. The day of starting the provision of child care services in DS is the day of registration in the provider's records. A maximum of 24 children can be looked after in the DS.

PART II. ORGANIZATION FOR THE PROVISION OF CHILD CARE SERVICES

Article 2 PERSONNEL OF THE CHILDREN'S GROUP

2.1. DS personnel are employees of the provider. The professional competence of DS personnel and their number is ensured in accordance with the Act.

Article 3 TIME OF PLACEMENT OF THE CHILD

3.1. A child can visit DS either full-day (ie two or three half-days, half-day = 3 hours), or for a reduced daily period in the event that he/she takes turns at one place with another child also placed there for a reduced daily period (ie one half-day), or only on certain days of the week in the event that he alternates in one place with another child placed there on other days of the week.

3.2. If the facility has free capacity, it is possible to place a child occasionally, but priority is given to a child who is placed in the DS all day.

Article 4 REQUEST FOR PLACEMENT OF CHILD

4.1. The application for placement of the child in the DS (hereinafter referred to as the "application") shall be submitted by the child's legal representative on the prescribed form (Appendix No. 2). The application is submitted to the director of the DS and is assessed in accordance with the criteria for admitting a child to the DS (Appendix No. 3), (hereinafter referred to as "criteria"). The director of the DS will notify the child within 14 calendar days of the submission of the request of the legal representative on whether or not to admit the child to the DS.

4.2. In the event that all positions in the DS are filled, the submitted applications will be evaluated based on the Criteria. If there is a vacancy in the DS, the director will notify the legal representative.

Article 5 AGREEMENT FOR THE PROVISION OF CHILD CARE SERVICES AT THE ABACUS CHILDREN'S GROUP

5.1. After notifying the legal representative of the child's admission to DS, the director prepares a contract for the provision of childcare services in the Abacus children's group. The contract is signed by the director and the child's legal representatives. If the legal representatives do not provide the necessary cooperation to conclude the contract, the contract may be concluded with the next applicant in the order. Consent to the processing of personal data is an integral part of the contract for placement in DS.

5.2. The contract is concluded for a fixed period. If, during the adaptation period, based on an assessment by the DS staff, it is found that the child is not able to stay in the DS, the director may withdraw from the contract.

5.3. The maximum period for concluding the contract is until the day the child starts school.

5.4. When a child is admitted to the DS, the director agrees with the child's legal representative on the days of attendance and the length of stay on these days in the DS, as well as the scope of meals during the stay in the DS. If the legal representatives request a change to these agreed conditions, this change must be agreed upon again with the DS director and confirmed in writing in the form of an addendum to the contract.

Article 6 FOOD AND BEVERAGES

6.1. Lunch, morning and afternoon snacks are provided by the DS provider, if the legal representative of the child placed in the DS does not use the possibility of individual meals.

6.2. Serving food and preparing a drinking regimen is provided by DS staff.

6.3. Information about the food supplier, the menu, including the price list, and the conditions for canceling the food order are available in the DS. Payment conditions are part of the agreement between the provider and the child's legal representatives.

Article 7 PAYMENT FOR PLACEMENT OF A CHILD IN A CHILDREN'S GROUP

7.1. The childcare service in the Abacus children's group is provided with partial reimbursement of costs by the legal representatives. Boarding is fully covered by legal representatives.

Article 8 TERMINATION OF CONTRACT

8.1. The contract for the provision of services for a child in DS will be terminated by the expiration of the period for which it was concluded, by agreement, by the provider's withdrawal from the contract or by the termination of both contracting parties, for the reasons specified in the contract.

Article 9 ORGANIZATION OF ABACUS CHILDREN'S GROUP

9.1. The DS organization is governed by the Operating Rules. In order to ensure the quality of care provision, operational and organizational matters of child care provision in DS, records of children are kept. The records contain the data specified in § 11 of the Act.

9.2. When the child joins the DS, the child's legal representative fills in the child's registration sheet in the DS and submits a doctor's statement about the state of health, including a vaccination certificate, or proof that he is immune to the infection or that he cannot undergo vaccination due to a permanent contraindication.

9.3. The written documents of the child placed in the DS are stored in the personal files kept by the director of the DS. The child's legal representative is obliged to report in writing within 10 days at the latest any changes to the data specified in the application for placement, or in the Child's Record Sheet.

9.4. In the event of a change in the state of health stated in the Child's Record Sheet, the legal representatives will request a new doctor's statement on the state of the child's health. When symptoms of illness occur in a child, the care staff is obliged to inform the child's legal representative free of charge and hand the child over to him or ensure the provision of health services.

9.5. The legal representative or representative is obliged to report the child's absence by e-mail, text message or by telephone to the person caring for the child as soon as possible, but no later than 8:15 am on the day of the excused absence. If the legal representative does not excuse the child's absence within the period specified in the information about the food supplier according to Article 6.3. of these rules, he will be charged a meal fee in the amount according to the price list.

Article 10 OPERATION OF THE CHILDREN'S GROUP

10.1. DS is open on weekdays from 7:30 am to 4:30 pm, and in the evenings and on weekends by appointment with DS staff.

10.2. DS operation may be restricted or interrupted by the DS provider. The DS provider will notify the legal representatives of the planned restriction or interruption of DS operation no later than 14 calendar days in advance (eg repairs and reconstruction, painting, regular building maintenance, cleaning of floors and carpets, sanitation day, etc.).

10.3. The operation of the DS can be limited or interrupted by the DS provider at another date, for serious reasons that make it impossible to properly provide the child care service (eg the occurrence of an infectious disease, flu or other epidemic, government measures, personnel reasons, technical defects, etc.) The DS provider will notify the legal representative of the information about the restriction or interruption of the operation immediately after deciding on the restriction or interruption of the operation.

10.4. The legal representative is obliged to pay the costs for the childcare service in the Abacus children's group even in the event of interruption or restriction of operation for the reasons specified in Article 10.2. and 10.3.

10.5. Complaints, notices and suggestions regarding the work of the DS can be delivered by post, email or in person to the director of the DS, or to the staff of the DS, who will immediately forward them to the director of the DS for processing. Complaints, notices and suggestions will be dealt with within 30 days of delivery.

Article 11 INSURANCE

11.1. The provider has an insurance contract for liability insurance against damage caused when providing childcare services in a children's group. This contract is concluded for the entire period of provision of child care services in DS.

Article 12 CLEANING AND DISPOSAL OF LAUNDRY

12.1. Cleaning is ensured in all areas in which the child care service is provided in DS in the following scope:

a) wiping all floors and surfaces, cleaning carpets with a vacuum cleaner - daily
b) taking out garbage - daily, washing sinks, toilets and children's potties use of disinfectants - daily

c) washing and disinfecting the washable parts of the walls of the sanitary facility - once a week, if necessary immediately
d) changing bedding at least once every 3 weeks, changing towels once a week, if necessary immediately
e) washing windows including frames, lamps and light sources - 1x every 6 months
f) general cleaning of all premises, including wet cleaning of carpets and objects including toys - 1x every 6 months
g) painting - as needed, but at least 1x every 3 years

12.2. The DS director or a representative authorized by him is responsible for the above, with the exception of the activities listed in Article 12.3.

12.3. Caregivers are responsible for cleaning toys, changing towels and removing and making bedding. Caregivers are also required to maintain a sufficient supply of clean towels and bed linen intended for immediate replacement and to ensure that they are washed, according to the instructions of the DS director.
